These Terms of Service ("Terms") are an agreement between you and Free My Budget("we," "us") for your use of Free My Budget (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Free service. The Service is provided free of charge. We may add, change, limit or remove any feature at any time, and we may stop offering the Service entirely, with or without notice.
Donations. You may choose to make a voluntary donation through our payment provider, Square. Donations are a gift, not payment for the Service, and do not create any obligation, warranty or service commitment on our part. They do not unlock features or support, and they are not tax-deductible. Donations are non-refundable except where required by law. Square processes all payment details under its own terms, and we never receive your full card information.
Eligibility. You must be at least 18 years old and able to form a binding contract to use the Service.
Not financial advice. The Service is a personal tracking tool. Nothing in it, including balances, categories, budgets, goals, net worth figures, recurring bill detection or AI-generated suggestions, is financial, investment, tax, legal or accounting advice. Figures shown may be incomplete, delayed or wrong. Always check your actual bank and card statements before making any financial decision, and consult a qualified professional for advice.
Your account. You are responsible for keeping your login secure and for all activity under your account. Tell us promptly at questions@freemybudget.com if you believe your account has been accessed without permission.
Your data. You own the information you add to the Service. You are responsible for its accuracy, including statements you import and categories or budgets you set. You give us permission to store and process it only as needed to run the Service for you.

We may suspend or close any account that we believe breaks these rules.
Bank connections. If you link a bank, card or loan account, the connection is provided by a third-party data aggregator, currently SimpleFIN. You authorize us and that provider to retrieve your account information on your behalf. Linked data can be delayed, incomplete or incorrect, and connections can stop working at any time. We are not responsible for the provider's service or for any action your financial institution takes.
AI features. Optional features such as automatic categorizing send transaction descriptions to a third-party AI provider to generate suggestions. AI output can be wrong. Review it before relying on it.
Third-party services. The Service relies on outside providers for hosting, database, sign-in (including Google sign-in), bank data and AI. Their terms and privacy policies apply to your use of their services. We do not control them and are not responsible for their availability, security or conduct.
Security. We take reasonable steps to protect your data, but no online service is completely secure. We cannot guarantee that your data will never be accessed, disclosed, altered or lost through a breach, error or failure, including one at a third-party provider.
No backups guaranteed. The Service is not a record-keeping or backup system. Data may be lost, corrupted or deleted, including when the Service changes or shuts down. Keep your own copies of anything important, including your original statements.
Deleting your account. You can delete your account at any time from within the Service. Deleting it removes your data from the Service, and it cannot be recovered.
Privacy. Our Privacy Policy explains what we collect, how we use it and who we share it with. It is part of these Terms.
Disclaimer of warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY DATA, CALCULATION OR SUGGESTION IN THE SERVICE IS CORRECT OR COMPLETE.
Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, CONTRACTORS AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, PROFITS, DATA, OR GOODWILL, INCLUDING LOSSES FROM FINANCIAL DECISIONS, MISSED PAYMENTS, FEES, OVERDRAFTS, OR UNAUTHORIZED ACCESS TO YOUR DATA, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. ANY DIRECT DAMAGES ARE LIMITED AS DESCRIBED BELOW.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO US $50. THESE LIMITS APPLY TO ALL THEORIES OF LIABILITY, WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Some jurisdictions do not allow certain warranty exclusions or liability limits. In those places, these limits apply to the fullest extent the law allows.
Your sole remedy. If you are unhappy with the Service, your only remedy is to stop using it and delete your account.
Indemnification. You agree to defend and hold us harmless from any claims, losses and costs, including reasonable legal fees, arising from your misuse of the Service or your breach of these Terms.
Termination. You may stop using the Service at any time. We may suspend or end your access, or shut down the Service, at any time and for any reason. Sections 2 (your data), 4, 5 and 6 survive termination.
Changes to these Terms. We may update these Terms. When we do, we will change the date at the top and, for significant changes, notify you in the Service or by email. Continuing to use the Service after changes take effect means you accept them.
Governing law. These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in King County, Washington, and you and we consent to their jurisdiction.
General. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them in connection with a sale or transfer of the Service.
